The short version
- You get a personal licence to use FocusPulse and to listen to its soundscapes inside the app.
- Premium is an auto-renewing subscription billed by Apple; you cancel it in your device Settings.
- The soundscapes are ours to license to you, but not yours to extract, publish or resell.
- FocusPulse is music software, not a medical device, and it makes no health claims.
- Nothing here takes away rights you have as a consumer under your local law.
1. Who these terms are with
FocusPulse (the “app”) is published by B&B LLP (“we”, “us”), registered in [jurisdiction] under company number [registration number], registered address [registered address]. By downloading or using the app you accept these terms. If you do not accept them, do not use the app.
These terms sit alongside Apple's Licensed Application End User Licence Agreement, which also applies to your copy of the app. Where the two conflict on a matter Apple's agreement governs, Apple's agreement wins.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices you own or control, and to listen to the soundscapes through the app, for your own non-commercial use.
You may not: extract, download outside the app, copy, publish, broadcast, stream, or redistribute the audio or artwork; use them in your own recordings, videos, streams or products; play them as background music in a commercial venue; reverse-engineer the app except to the extent that restriction is unenforceable under your local law; or use the app to break the law.
3. Subscriptions, billing and cancellation
Some depths and features are part of Premium, an auto-renewing subscription sold through the App Store. Prices are shown in the App Store before you buy, in your local currency.
- Billing. Payment is charged to your Apple ID at confirmation of purchase.
- Renewal. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of that period.
- Introductory periods. Where an introductory or trial period is offered, the paid subscription begins when that period ends unless you cancel at least 24 hours earlier. Any unused portion of an introductory period is forfeited if you buy a subscription during it.
- Managing and cancelling. Manage or cancel at any time in Settings → your name → Subscriptions on your device. Deleting the app does not cancel a subscription.
- Refunds. Purchases are handled by Apple, so refunds are requested from Apple at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves. This does not affect statutory rights you may have.
We may change what Premium includes or what it costs. Price changes take effect on the renewal after we tell you, and you are free to cancel before it applies.
4. The music
The soundscapes, cover artwork, sigil designs, name and interface of FocusPulse are owned by or licensed to B&B LLP and are protected as far as applicable law allows. Your licence is to listen inside the app — nothing in these terms transfers ownership of anything to you.
Our soundscapes are instrumental and wordless, and they are produced with the help of generative AI tools under commercial licences held by B&B LLP, then selected, edited, sequenced and mastered by us. We describe that process openly on The music. We do not use recordings owned by third parties, and we do not imitate identifiable artists.
If you believe any content in the app infringes your rights, write to [email protected] with enough detail to identify the work and your claim, and we will investigate promptly.
5. Not medical advice, and listening safely
FocusPulse is music software for focus and rest. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and nothing in the app or on this site is medical, psychological or professional advice. We make no scientific claims on your behalf; where the app tests whether its Pulse helps your own focus, that result is a personal observation, not a clinical finding.
Please listen at a moderate volume — prolonged loud listening can damage hearing — and do not use the app in any situation where reduced attention to your surroundings would be unsafe, such as driving or operating machinery. If you have a condition affected by sound or rhythmic stimulation, talk to a qualified professional before using the app.
6. Availability and changes
We work to keep the service running, but we do not promise uninterrupted availability. The catalog can change: tracks and states may be added, replaced or withdrawn, including where a licence ends. We may update, change or discontinue features, and we may discontinue the app itself — if we do, we will give reasonable notice where we can, and paid subscribers will be treated fairly in line with App Store rules.
7. Disclaimers
To the maximum extent permitted by law, the app and the service are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will meet your requirements or that it will be error-free.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of or inability to use the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for it in the twelve months before the claim, or [GBP 100].
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — including your non-excludable rights as a consumer.
9. Ending the licence
You may end this licence at any time by deleting the app. We may suspend or end your licence if you materially breach these terms — in particular by extracting or redistributing the audio. The sections on the music, disclaimers, liability and governing law survive termination.
10. Apple
These terms are between you and B&B LLP, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
11. Governing law and disputes
These terms are governed by the laws of [England and Wales], and the courts of [England and Wales] have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the protection of any mandatory laws of your country of residence and may bring proceedings there.
12. Changes to these terms
We may update these terms; the current version always lives at this address with its version number and effective date. If a change is material we will give notice in the app's release notes. Continuing to use the app after a change takes effect means you accept the updated terms.
